“Contract” refers to a legally binding document agreed upon between CTWDG and the Client regarding the terms of the sale, purchase and provision of any Service, Work or Project.
“Licence Agreement” refers to a legal document which outlines the rights held by the relevant Parties with regard to how each Party can use the Work.
The purpose of these Terms of Service is to establish and make clear, for both Users and Clients, how these Terms of Service apply to the Services provided by CTWDG, how CTWDG operates as a business and to outline the expectations, obligations and rights of all Parties.
Please read through these Terms of Service carefully as they apply to all Users of this Website and to all Clients of Chris the Web Design Guy.

CTWDG is an independent, freelance web design business run as a one-man operation which aims to provide a straightforward, web design and management solution.
Always open to new Projects, CTWDG offers a free quote to all prospective Clients after an enquiry/discussion with no obligations whatsoever.
CTWDG reserves the right to reject any Client or Project considered to be immoral, abusive, grossly offensive or illegal.
CTWDG aims to provide an excellent Service and to fully meet Client expectations, therefore CTWDG reserves the right to refuse any Project deemed to be outside the scope of CTWDG's Services.
CTWDG reserves the right to change, end or re-sell the Service(s) at any time but will provide due notice to existing Clients should such a change occur.
CTWDG Websites are built and maintained using WordPress and a number of different tools and plugins to ensure for high performance, ease-of-use and reliability. All Sites are built and designed, 100% by hand, on a custom CTWDG template - no libraries, no pre-built pages or elements and no AI. With flexibility and integrity of design at the heart of every CTWDG Website, this custom template allows for Site builds that easily incorporate the aesthetics and design style of the Client, resulting in epic, full scale, responsive Websites at fast turnarounds.
Clients are allowed two free revisions before the Website is launched. For any further revisions before the Site is launched, the Client will be charged at a rate based on the size of the revision/Project scope determined by CTWDG.
Existing Clients on the Maintenance Service plan (see below) are granted discounted future Website redesigns. The discount rate is based on the size of the redesign and is negotiated between CTWDG and the Client before any redesign takes place.
All Websites built and designed by CTWDG are, and remain always, the copyrighted property of CTWDG. The contents of the Website (images, text, intellectual property and other assets/content supplied by the Client) are, and remains always, the copyrighted (where applicable) property of the Client and/or their respective copyright holders.
CTWDG reserves the right to use any Website Design Project for its own marketing and promotional purposes.
Clients do not have the right to replicate, duplicate, redistribute, sub-license or pass-off as their own any Website in any way, shape or form. Doing so will result in legal action being taken.
CTWDG uses the highest level of security technologies available in order to protect and keep its Clients and its Websites safe from hackers and other threats. Should a successful hack (or breach of any kind) be made, CTWDG will make every effort to restore any Website to its former state and to recover any lost data. CTWDG cannot accept any liability for any losses or damages whatsoever caused by any malicious Third Parties, hackers or attacks.
CTWDG makes every effort to ensure all Websites are compatible and work well with all modern web browsers and devices but cannot guarantee that all Websites will display and function correctly/as intended for all visitors as it is impossible to account for the multitude of all web browsers/devices available to the general public.
All CTWDG Websites come with a locked in Maintenance Service which provides the following:
The Maintenance Service will start on the date the Website is launched. The Client must set up a recurring payment method within 30 days of the Maintenance start date as instructed by CTWDG. The Maintenance Service is cancellable at any time. For more information on cancelling, please see the section entitled “Exit Process” below for more details.
The Maintenance Service is only available for new or existing CTWDG Clients. It does not come as a standalone Service.
Please note that the monthly recurring charge for the Maintenance Service is subject to change, though CTWDG will always endeavour to avoid any increases in charges and to keep charge increases fair should any occur. Clients will be made aware and notified of any increases, should they arise, via their given contact details/communication channel(s).
The Client agrees to maintain up-to-date card/payment details to ensure payments are processed correctly without issue. Failure to do so will ultimately result in the discontinuation of the Maintenance Service. For more details, please see the "Failed Payments" section below.
As part of the Web Design and Maintenance Service, Clients agree to transfer any existing domain name(s) to CTWDG for hosting, management and Site build purposes.
The Client retains all associated rights and ownership of their domain name(s). CTWDG does not assume any rights or ownership over the Client’s domain name(s) other than to host and manage the domain name on behalf of the Client.
CTWDG will host the domain name and Website for its Clients on its own Web Hosting account to easily manage and maintain the Client's Website. Domains managed by CTWDG also include SSL Certificates and WHOIS privacy protection.
A domain name will be agreed upon during the initial Web Design Project discussions if the Client does not already have one.
Domain name(s) can be transferred back to the Client from CTWDG's hosting account should the Client wish to leave/cancel their Maintenance Service with CTWDG. For more information, please see the section entitled “Exit Process” below.
Before the transfer of any existing domain names, it is the Client’s responsibility to pay any outstanding balances the Client has with their own hosting company/domain name provider. It is also the Client’s responsibility to cancel any future payments and remove any payment methods held by the Client’s existing hosting company/domain name provider so as not to incur any future unnecessary charges.
CTWDG uses Krystal Hosting LTD as its hosting platform and domain name provider and so cannot be held solely liable for any losses or damages whatsoever caused by any downtime, errors or breakage with regard to domain names, hosting or Website downtime. Instances may arise where CTWDG and the Client may need to share sensitive data in order to transfer domain name(s)/hosting. CTWDG takes the security and protection of all sensitive data extremely seriously and will never share or compromise any sensitive data in any way whatsoever and cannot be held solely liable for any damages, charges or repercussions caused by the loss of any shared data.
CTWDG Websites are built with SEO practices in mind to increase page speed and search results rankings and is a standard, no extra cost feature of all CTWDG Websites.
SEO is a live and ever changing entity and therefore, due to its inherent unpredictability, CTWDG cannot be held liable for any damages or losses caused by any drops in traffic as multiple, unforeseeable factors can influence the way pages rank and score on various search engines.
Pre-existing material(s) refers to any artwork, design, imagery, logo or any other media or asset not produced by CTWDG.
Regarding the use of any pre-existing material(s) in any Project(s) between CTWDG and the Client, the Client grants permission to allow CTWDG the use of any supplied pre-existing materials(s) prior to any Project/Work being carried out by HWM.
It is the Client’s responsibility to ensure that any pre-existing material(s) supplied to CTWDG by the Client does not infringe upon any copyright(s) of any Party or Third Parties and remains lawful. By supplying any pre-existing material(s), the Client declares that they hold the necessary permissions and copyright(s).
CTWDG will credit the original creator(s) of any pre-existing material(s) used in any Project/Work wherever possible.
CTWDG reserves the right to refuse any copyrighted material submitted by the Client and will cease any Project/Work should any copyright claim be confirmed.
CTWDG cannot be held liable, responsible or accountable for any copyright infringement(s), damages or costs whatsoever related to any material(s) supplied to CTWDG by the Client.
CTWDG supplies and implements a pre-written Privacy Policy for its Web Design Clients and manages cookies and cookie consent banners as part of the Web Design Service. Both are provided in good faith, using standard practices intended to address the key points required under GDPR and online privacy regulations. CTWDG is not a solicitor nor a legal professional and does not provide any legal advice. Clients remain solely responsible for ensuring their Privacy Policy and cookie practices are accurate, valid, and compliant with applicable laws. CTWDG strongly recommends that Clients seek independent legal advice to verify compliance.
CTWDG cannot be held liable whatsoever for any repercussions, losses, damages, legal claims, or fees arising from the use of the supplied pre-written Privacy Policy, cookies, or related tools, including any updates or future iterations.
In order to carry out and complete any agreed upon Project(s), CTWDG requires the Client to transfer any requested and agreed upon files, such as images and text. The Client understands that any delays in the supply of the necessary content/assets may jeopardise and delay the timescales of the Project.
If the Client fails to supply the requested content/assets after 14 days of having been requested, the Project will be paused for a further 14 days. Should the Client still fail to supply the requested content/assets within 28 days in total, the Contract will be made void and terminated and the Project will be cancelled. Payment(s) will still be required for any work already completed up until the point of termination/cancellation.
CTWDG cannot be held liable for any damages or losses whatsoever caused by the delay of the supply of any content/assets by the Client.
Websites are expected to be completed between 7-14 working days. (Please note that where domain name/hosting transfers are required, timescales may increase due to both CTWDG and the Client being reliant upon their respective domain name/hosting providers in order to complete the transfer).
Although CTWDG will always endeavour to meet all timescales and deadlines, CTWDG cannot be held liable for any losses or damages due to any delays in timescales or service provision whatsoever.
Contracts must be signed by both CTWDG and the Client and returned before any Project/Work will begin. Once signed, the Contract then becomes a legally binding document that both CTWDG and the Client must adhere to.
Payment(s) are only accepted via debit card or bank transfer via Stripe.
CTWDG is not responsible for any transaction fees that the Client’s bank may charge.
All prices and payments are processed in GBP (£). International Clients may pay in their local currency through Stripe with conversion being handled by their payment provider. The Client is solely responsible for any currency conversion charges, bank fees or international transfer costs applied by their payment provider. CTWDG accepts no liability for any such additional costs.
PROJECTS:
Clients are required to pay a 50%, non-refundable deposit. This is due after a Project has been agreed upon, a Contract has been signed and the Client has supplied their content/assets.
Once the first 50% deposit has been received, work on the Project will begin.
The final 50% is due after the Project has been completed and approved. After the final 50% payment, the Project will then be launched/supplied/released.
MAINTENANCE SERVICE:
Payments are set up as monthly recurring debit card payments or Direct Debits via Stripe. The first payment is due within 30 days of the Website launching.
DEPOSIT:
Following 30 days of non-receipt of payment, the Contract will be made null and void and the Project will be cancelled.
FINAL 50%:
Non-receipt of payment will result in the Project being held/unreleased for up to 30 days until receipt of payment. Should no payment be made within or up until 30 days, the Contract will be made null and void and the Project will be terminated and deleted where applicable (including any material(s) supplied by the Client). Projects terminated before launch or release due to failed payments cannot be resumed or renewed due to the aforementioned Project deletion.
MAINTENANCE SERVICE:
Following one missed payment, the Client will be offered a single “grace period” until the next payment is due. Following any additional missed payment(s), the Client’s Website will be suspended (for up to 90 days) and will only be unsuspended once payments are resumed. If no payment is received after 90 days, the Website will be taken down and the Maintenance Service will be terminated. This will then initiate the Exit Process (for details, please see the section entitled “Exit Process” below).
CTWDG shall be under no obligation to provide any Service(s) or final Project(s) before any and all outstanding payment(s) have been made.
CTWDG will not be held liable for any damages whatsoever caused by any Website suspension or Project delays caused by late Client payments.
Clients may cancel any Project for any reason at any time. Cancellation applies upon written receipt by CTWDG via email at hello@christhewebdesignguy.com. Please note that the initial 50% deposit is non-refundable.
Once a Project is completed, approved and paid for by the Client, thus CTWDG having delivered the Project/Work as agreed upon within the Contract and the Client being satisfied with and having approved the completed Project, no refunds can be offered.
Clients can cancel their Maintenance Service at any time. The Maintenance Service will remain active after cancellation up until the date of when the next payment would be due (for example, a Client started their Maintenance Service on 28th of June and cancels on the 14th of July, the Maintenance Service would remain active until 28th of July, when the next payment would be due).
After cancellation or termination, the Website and domain will be handed over to the Client. The Client will then take on full responsibility for the following:
Once the Exit Process is complete and the Website is handed over to the Client, the Client understands and agrees that while they may continue to use the Website as it was delivered, the underlying design system, templates, code structure and proprietary methods used by CTWDG remain the copyrighted property of CTWDG.
The Client is free to update, edit and manage their Website as they see fit, including reworking or redesigning it in full. However, unless the Website is substantially redesigned, the original CTWDG design and framework cannot be resold, re-licensed, duplicated or passed off as the Client’s own creation.
Clients understand that once the Maintenance Service is cancelled and the Website has been handed over to the Client, CTWDG has no responsibility whatsoever for the Clients’ Website nor any aspect the of upkeep or maintenance of the Website and is under no obligations whatsoever to provide any support to Clients who have cancelled and exited.
Please allow up to 60 days to fully complete the Exit Process.
Ex-Clients are welcome to return to CTWDG and resume their Maintenance Service. Please note that here is a charge drawn up on a case by case basis.
IMPORTANT NOTICE!: In cases where the Maintenance Service has been terminated due to failed payments (see the section entitled “Failed Payments” above) and the Client fails to co-operate or communicate with CTWDG in the handing over/transfer process of the Website and domain, CTWDG will cancel and remove any domain name(s) and hosting renewal(s) and delete the Website and all related material(s) after a period of 60 days.
CTWDG is the sole copyrighted owner of the CTWDG logo, name, Website and associated branding protected by copyright law. Any individual(s) who violate(s) the copyright of, or attempt(s) to replicate, duplicate, plagiarise, redistribute, sub-license or pass-off as their own, the Website or any CTWDG branding or any other CTWDG intellectual property in any way, shape or form will face legal action being taken against them.
Legal action will be taken should any Client attempt to use any Work by CTWDG before final payment has been received.
CTWDG utilises various Third Party tools and technology in order to operate and although CTWDG will make every effort to resolve any issues or errors that may occur as swiftly as possible, CTWDG accepts no liability for any losses or damages whatsoever caused by Website downtime, errors or breakage due to any Third Party service failure. This also applies to any routine Website maintenance.
CTWDG has no control, liability nor responsibility for and does not endorse, in any way, shape or form, the content, reliability, accuracy or validity of any material(s) found via or within any Third Party services or links found within this Website.
CTWDG accepts no liability whatsoever for any copyright infringement claims, or unlawful use, caused by material(s) or media submitted by the Client or used by the Client in any future Website or Project whatsoever.
CTWDG endeavours to provide a timely, error-free and secure Service but shall not be held liable should CTWDG fail to do so. The use of the Service(s) offered by CTWDG is at the User’s own discretion/risk and is offered “as is”, without any warranty of any kind, express or implied, and cannot guarantee that the Services will meet/satisfy all Client expectations (though every effort will be made to do so) or be error-free. CTWDG shall not be held liable or accountable for any losses, damages or any claims of any other kind resulting in the Client’s use of the Service(s) or this Site.
The provisions of these Terms of Service are not affected by, nor made invalid, should CTWDG fail to comply with any of the provisions of these Terms of Service.
If, for any reason, a court of competent jurisdiction finds any terms, clauses or conditions of these Terms of Service to be unenforceable, all other terms, clauses and conditions of these Terms of Service shall remain unaltered and enforceable.
You agree to indemnify and hold harmless CTWDG against any claims, demands, losses or damages in whatsoever manner, by any Party, howsoever caused due to or arising out of your breach of these Terms of Service or violation of any law or rights of any Third Parties.
CTWDG reserves the right to use any Project for marketing and self-promotion (on social media and elsewhere). This is beneficial for both CTWDG and the Client as it helps to promote both Parties and increase exposure.
CTWDG shall not use or share any confidential or sensitive information given by the Client in any way other than for the purposes of completing the Work agreed upon between CTWDG and the Client.
These Terms of Service are subject to change. Any changes to these Terms of Service will be updated on this webpage. Clients will be updated and notified of any changes via their given contact details/communication channel(s).
As CTWDG is a business operation, it is only intended for those above the age of 18 years. By continuing to use this Website/Service, You declare that You are above the age of 18 years.
